Introduction

These Terms of Service ("Terms") govern your access to and use of the TicketIt platform, including our website, mobile applications, and related services (collectively, "Services").

By accessing or utilizing our Services, you agree to be legally bound by these Terms, which form a binding agreement between you ("User" or "you") and TicketIt ("we," "us," or "our").

If you do not agree to these Terms, you must refrain from using our Services.

Eligibility to Use Our Services

To use our Services, you must be at least 13 years of age and possess the legal capacity to enter into binding agreements.

If you are registering on behalf of an organization, you represent and warrant that you have the authority to bind that entity to these Terms.

We reserve the right to refuse service or terminate accounts at our sole discretion if eligibility criteria are not met.

Account Registration and Responsibilities

To access certain features, such as ticket purchases, you must create an account by providing accurate, current, and complete information as prompted.

You are solely responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities conducted under your account.

We are not liable for any loss or damage arising from your failure to safeguard your account.

Ticket Purchases and Transactions

TicketIt facilitates the purchase of tickets for events hosted by third-party organizers ("Event Organizers"). We act as an intermediary and are not the organizer of these events.

All ticket prices, fees, and availability are determined by Event Organizers and are subject to change without prior notice.

Payments are processed through secure third-party gateways. You agree to provide accurate payment information and authorize us to charge the specified amount for your transaction.

Tickets are non-transferable unless explicitly permitted by the Event Organizer and may not be resold for commercial purposes without our express consent.

Refunds and Cancellations

Refund policies are set by Event Organizers and vary by event. TicketIt will process refunds only in accordance with the applicable Event Organizer’s policy.

In the event of cancellation or postponement, we will notify you via email or platform updates and facilitate refunds or ticket exchanges as directed by the Event Organizer.

We are not responsible for additional costs (e.g., travel or accommodation) incurred due to event changes or cancellations.

User Conduct and Prohibited Activities

You agree to use our Services in compliance with all applicable laws, regulations, and these Terms.

Prohibited activities include, but are not limited to: (a) attempting to interfere with or disrupt the functionality of our Services; (b) using automated tools to scrape data; (c) engaging in fraudulent transactions; (d) posting unlawful, defamatory, or abusive content; and (e) infringing on the intellectual property rights of others.

Violation of these restrictions may result in immediate account suspension or termination, and we may pursue legal action where warranted.

Intellectual Property Rights

All content, trademarks, logos, and software on our platform are the property of TicketIt or our licensors and are protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our Services for personal, non-commercial purposes only.

You may not reproduce, modify, distribute, or create derivative works from our content without prior written permission.

User-Generated Content

By submitting content such as reviews, comments, or ratings ("User Content"), you grant TicketIt a worldwide, royalty-free, perpetual license to use, display, and distribute such content in connection with our Services.

You represent that your User Content is original, does not infringe on third-party rights, and complies with these Terms.

We reserve the right to monitor, edit, or remove User Content at our discretion, particularly if deemed inappropriate or harmful.

We are not liable for losses resulting from events beyond our reasonable control, including but not limited to natural disasters, cyberattacks, or Event Organizer actions.

You agree to indemnify and hold TicketIt harmless from any claims, damages, or expenses (including legal fees) arising from your misuse of our Services, violation of these Terms, or infringement of third-party rights.

Dispute Resolution and Governing Law

These Terms are governed by the laws of the Republic of Kenya, without regard to conflict of law principles.

Any disputes arising from or related to these Terms shall first be addressed through good-faith negotiation between the parties.

If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts in Nairobi, Kenya, unless otherwise required by applicable regional laws.

Termination of Services

You may terminate your account at any time by following the instructions in your account settings.
